FERMA invites one student per association to attend the Risk Management Forum held in different places throughout Europe. The 2007 Forum takes place in Geneva from September 30 till October 3.

BELRIM, the Belgian Risk Management Association, will select a Belgian student based on the following criteria:

  1. the student will have succeeded in any educational program devoted to Risk Management in 2006 or later

 

  1. the student will have a sufficient knowledge of the English language
  1. the student should produce a report within three weeks following the Forum

 

Students can register by sending a letter of motivation and a copy of their thesis to info@belrim .

The Education committee of Belrim will study and compare all entries and the winner will be contacted by the end of August.

Subject: FERMA FORUM 2005 - STUDENTS REPORTS

Dear members,

All the students invited by FERMA in Lisbon have submitted a report. It includes general views on the Forum and the developments of some ideas on a subject of risk management. These reports have been submitted to the Education Committee.

After discussions, the report of Mr Anders Jacobson, who was selected by Swerma – Sweden has been rewarded. His report entitled « Risk Perception and Management » will be published on the FERMA website. We invite you to publish it on your own website and to propose to communicate for publication the report for the specialized press. Mr Anders Jacobson will be invited by FERMA to attend the Seminar in October in Brussels on 11th October 2006.

It has also be noted a special mention for the Russian student, Marina Lepeshkina who has produced a very documented report on problems of investments in construction and management projects in her country. The report is prepared for her thesis and is very technical and mathematic and will be proposed for more scientific magazines.

Finally, we encourage all of you to keep and develop contacts with the academics and have a better selection of the students. It has been noted that some of them did not know about the association who had selected them and very few about FERMA.

Mexican brokers face new disclosure rules


An agreement over broker disclosure has been reached between Mexico's insurance regulator CNSF and the country's insurance association Amis. The agreement comes after supervisors in North America revealed how brokers enter into side arrangements with insurers over commissions related to business volume.

The new rules being planned by supervisors in Mexico will require greater disclosure of the commissions that insurers pay brokers and agents to sell their products.

Under new rules that will take affect from January 1, 2006, all policies will include a clause informing insurance buyers that they can ask the insurer how much the broker or agent was paid. Once notified, the insurer has 10 days to respond.

At the same time insurers will have to disclose in their financial statements the brokers who receive contingent commissions, the type of contingent commission paid, and the amount of contingent commissions paid out as a percentage of premiums.

Contingent commissions are fees paid to brokers by insurers in addition to direct commissions. Contingent commissions are based on the volume of business placed with an insurer. Since regulators in the US started looking into the abuse of contingent commissions, where some brokers have directed business to those insurers who pay the most, brokers have pledged to stop accepting them.

The bulletin covering direct commissions is available for public comment on the website of federal agency Cofemer while the second bulletin dealing with contingent commissions will be posted shortly.

Amis says it wants to introduce the new rules to prevent any potential legal problems that could arise over commission transparency.

Welding-Fumes Suits Raise Specter of Costly Liabilities

A federal court in Cleveland indicated Sunday that it will allow lawsuits to go forward alleging that fumes from welding products caused workers to develop Parkinson's disease, a debilitating neurological malady. The situation raises the possibility of costly legal liabilities for companies involved in making and distributing welding materials. Still, any costs are unlikely to approach those from asbestos and defendants will still be able to challenge any evidence purporting to link the fumes and Parkinson's when individual lawsuits are heard. Companies have long argued that it is hard to pinpoint the genesis of neurological diseases such as Parkinson's, making it difficult for plaintiffs to prove that these maladies were caused by manganese, a metal used in rods and wires that has been recognized as unhealthy if its fumes are inhaled. Among the big current and former producers of welding materials being targeted in litigation are Lincoln Electric Holdings Inc. of Cleveland, which is the largest maker of welding equipment and rods based on sales. Also in focus are companies that distributed welding materials or were big users, such as General Electric and Caterpillar. "It is definitely a significant ruling," says Sigurd Sorenson, a lawyer at Clifford Chance US LLP in New York who has defended companies that were involved in asbestos and silica litigation. "Plaintiffs can make the argument that there is a connection between fumes and Parkinson's, and that gives plaintiffs a lot of leverage" to potentially pursue financial settlements. Welding-fumes cases have become an issue in the legal community, with lawyers placing ads to find workers with potential exposure. Plaintiffs' attorneys say there are about 10,000 current suits alleging neurological injuries from welding fumes and an estimated 500,000 or more workers with current, or past, exposure to welding fumes. If the problems even come close to those caused by asbestos, shares will suffer. Many companies that had even remote dealings with asbestos have faced heavy legal liabilities from suits related to alleged asbestos-related maladies. Sorenson and other attorneys say it is unclear if any of the suits will ever prove successful. Nonetheless, some investors following the cases have shown some jitters. Some companies say they have insurance coverage that could cover at least some of any litigation costs.

ACCIDENTS DU TRAVAIL: MODIFICATION

Selon les informations reçues, le gouvernement fédéral aurait pris la décision de ne plus indexer les rentes liées aux accidents de travail ayant causé moins de 20% d'invalidité.

Dès à présent cela a suscité des réactions syndicales mais également de la FEB qui estime qu'il s'agirait d'une mesure discriminatoire par rapport aux mêmes rentes servies par le Fonds des Maladies Professionnelles.

Il convient de suivre l'évolution de cette situation dont l'initiative semble incomber au Ministre Frank Vandenbroucke. Cela doit en effet avoir des conséquences sur la charge des assureurs et donc sur nos primes accidents du travail.
